WHAT IS A DECERTIFICATION ELECTION?

NOTICE: The National Labor Relations Board (“NLRB”) changed the rules for decertifying a union effective May 31, 2020.

The decertification process described on this webpage was updated to account for the new rules.

You (or someone you know) may be employed in a workplace where a union has the right to “represent,” and collectively bargain for, all employees.

This is frequently referred to as “exclusive representation,” but what it really means is that union officials have the power to make contracts that workers may not like while employees cannot negotiate their own terms of employment.
